How crypto is taxed
Germany treats crypto as a private asset under §23 of the Income Tax Act, which makes the one-year holding period the rule that shapes everything. Hold a coin for more than 365 days and the sale is completely tax-free, whatever the gain. Sell, swap or spend within a year and the gain is taxed at your personal rate, but only once your total private-sale gains for the year pass the €999.99 Freigrenze; cross that line and the whole amount is taxable. The 2025 proposal to stretch the holding period to ten years for staked or lent coins was dropped in the BMF letter of 6 March 2025, so the plain one-year rule covers those too.
Earned crypto is different: staking, lending, mining and airdrop rewards are income, taxed at your personal rate on the euro value the day you receive them, with a separate €256 Freigrenze. Your 2025 return is due at the Finanzamt by 31 July 2026, or 1 March 2027 with a Steuerberater. Reporting is tightening under DAC8, in force across the EU since January 2026.
