1. Acceptation

En créant un compte Kryptos ou en utilisant le Service, vous (a) acceptez ces Conditions et notre Politique de confidentialité et (b) confirmez avoir la capacité juridique de le faire dans votre juridiction. Si vous acceptez au nom d'une organisation, vous confirmez avoir l'autorité pour l'engager.

5. Propriété intellectuelle

Nous possédons le Service, y compris tous logiciels, designs, contenus et marques. Vous obtenez une licence non exclusive, non transférable, révocable d'utiliser le Service. Vous ne pouvez pas copier, modifier, faire du reverse-engineering ou revendre le Service.

Vos données vous appartiennent. Nous avons une licence limitée pour les traiter afin de fournir et améliorer le Service, sous réserve de la Politique de confidentialité.

6. Vos responsabilités

Vous acceptez de ne pas utiliser le Service à des fins illégales (évasion fiscale, blanchiment) ; tenter d'obtenir un accès non autorisé ; scraper ou republier notre contenu ; abuser des rate limits ; interférer avec le fonctionnement.

Vous êtes responsable de l'exactitude des données fournies et de la vérification des sorties avant dépôt fiscal.

3. Votre compte

Vous êtes responsable de la sécurité de vos identifiants. Vous devez nous notifier rapidement toute utilisation non autorisée. Nous pouvons suspendre ou résilier les comptes qui violent ces Conditions ou la loi applicable.

4. Abonnements et facturation

Les plans payants se renouvellent automatiquement à la date anniversaire de l'abonnement sauf annulation avant la date de renouvellement. Les upgrades sont facturés au prorata pour le reste de la période ; les downgrades prennent effet au renouvellement suivant. Les remboursements sont régis par notre Politique de remboursement.

6. Cancellation

You can cancel your subscription at any time by logging into your account or contacting us using the contact information provided below. Your cancellation will take effect at the end of the current paid term.

7. Prohibited activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to misuse the Site, harvest data, circumvent security features, frame or impersonate, decompile our software, or otherwise interfere with the Site or violate applicable laws. 8. User-generated contributions

The Site does not offer users to submit or post content. Where you do provide Contributions, you represent and warrant that they do not infringe third-party rights, are not false or misleading, are not unsolicited advertising or spam, are not obscene or harassing, and do not violate any law.

9. Contribution license

By submitting suggestions or other feedback regarding the Site, you agree that we can use and share such feedback for any purpose without compensation to you. We do not assert any ownership over your Contributions; you retain full ownership. You are solely responsible for your Contributions to the Site.

10. Submissions

Any questions, comments, suggestions, ideas, feedback, or other information regarding the Site ("Submissions") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

7. Services tiers

Votre utilisation de plateformes, wallets, blockchains et autres services tiers via Kryptos est régie par leurs propres conditions. Nous ne sommes pas responsables des pannes, erreurs ou changements dans ces services.

12. Site management

We reserve the right, but not the obligation, to monitor the Site for violations of these Terms, take appropriate legal action against violators, refuse or restrict access to your Contributions, remove burdensome files or content, and otherwise manage the Site to protect our rights and ensure proper functioning.

13. Privacy policy

https://kryptos.io/privacy-policy. By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Service. The Site is hosted in the European Union (EU); by using the Site you consent to the transfer of your data to the EU. We do not knowingly accept information from children under 13.

11. Résiliation

Vous pouvez annuler votre compte à tout moment depuis les paramètres. Nous pouvons résilier votre compte en cas de violation matérielle de ces Conditions, avec préavis raisonnable. À la résiliation, nous conservons les données selon la Politique de confidentialité.

15. Modifications and interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. We cannot guarantee the Site will be available at all times and reserve the right to modify or discontinue all or part of the Site without notice. We will not be liable for any modification, price change, suspension, or discontinuance.

12. Droit applicable et litiges

Ces Conditions sont régies par le droit de Singapour. Les litiges sont soumis à la juridiction exclusive des tribunaux de Singapour, sauf si des règles impératives de protection des consommateurs de votre pays exigent autre chose.

17. Dispute resolution

Informal negotiations. The Parties agree to first attempt to negotiate any Dispute informally for at least ninety (90) days before initiating arbitration.

Binding arbitration. Any dispute shall be determined by one arbitrator under the Arbitration and Internal Rules of the European Court of Arbitration. Seat of arbitration: Göteborg, Sweden. Language: English. Substantive law: Sweden.

Restrictions. No class-action arbitration; no representative-capacity claims.

Exceptions. IP disputes, theft/piracy/privacy claims, and injunctive-relief claims are not subject to arbitration.

18. Corrections

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

8. Garanties

10. Indemnisation

Vous acceptez d'indemniser Kryptos de toute réclamation découlant de votre violation de ces Conditions, de votre utilisation du Service en violation de la loi, ou de votre violation des droits d'un tiers.

22. User data

We will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site, as well as data relating to your use of the Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit. You agree that we shall have no liability to you for any loss or corruption of such data.

23. Electronic communications, transactions, and signatures

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS.

24. California users and residents

If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.

25. Miscellaneous

These Terms of Service constitute the entire agreement between you and us. Our failure to exercise or enforce any right shall not operate as a waiver. We may assign any or all of our rights and obligations to others at any time. Force majeure events are excused. Severability applies if any provision is found unenforceable. No joint venture, partnership, employment or agency relationship is created.
